At Blackwork, we strive to provide the highest quality digital collections and customer support. Due to the nature of digital products, refunds are generally not available once files have been downloaded or access has been granted.

Commercial License
Extended License

Both licenses are perpetual, worldwide, and non-exclusive. Copyright and ownership of the original assets always remain with Blackwork.

A Blackwork Asset is a single visual element included in a Blackwork Digital Collection.

Each asset comes from historical source material.
Assets are digitized, restored, organized, and quality-checked by Blackwork.

Why do I need a Blackwork license if the original illustrations were created by someone else?

Blackwork does not claim authorship of historical artworks.

Many illustrations in Blackwork collections were created decades or centuries ago. Whenever possible, we preserve information about the original author, source, and provenance.

What you receive with a Blackwork license:

If the original artwork is in the public domain, why do I need a Blackwork license?

Because the license covers access to Blackwork's curated collections and prepared digital assets, not ownership of the original historical artwork.

What is public domain?

Many historical works eventually enter the public domain when copyright protection on the original artwork expires.

In these cases, Blackwork does not claim authorship or ownership of the original historical work. We recognize and preserve the historical origin, authorship, and provenance of the material whenever possible.

What does Blackwork provide?

Historical images rarely exist as ready-to-use digital assets.

Before inclusion in a Blackwork collection, materials are sourced, acquired, digitized, restored, organized, documented, quality-checked, and enriched with metadata.

When does an artwork, book, document, or historical work enter the public domain?

In the European Union and in Italy, the general rule is that economic copyright protection lasts for the life of the author plus 70 years after the author's death.

This means that a work usually enters the public domain on 1 January of the year following the 70th anniversary of the author's death.

For example, if an author died in 1955, the work would generally enter the public domain on 1 January 2026.

For works created by multiple authors, the 70-year period is usually calculated from the death of the last surviving author.

For anonymous or pseudonymous works, the term may be calculated from the date the work was lawfully made available to the public, unless the author's identity becomes known.

Public domain status refers to the original historical work. It does not automatically apply to later editions, translations, annotations, restorations, photographs, scans, databases, metadata, or digital collections that may involve separate rights or independent creative, editorial, technical, or organizational work.

Blackwork evaluates historical source material carefully, but public domain rules can vary by country, work type, authorship, publication history, and applicable law.

Who is the Licensee?

Can I use Blackwork images in commercial projects?

Can I use the assets in products for sale?

Are AI training, datasets, or machine learning uses included?

No.

The Commercial License and Extended License do not include rights for AI training, machine learning, dataset creation, model training, fine-tuning, computer vision systems, embedding generation, synthetic data creation, or any other artificial intelligence-related use.

AI and machine learning applications are licensed separately and require a dedicated agreement with Blackwork.

We offer custom AI licensing solutions for companies, research institutions, universities, developers, and organizations interested in using historical visual material for artificial intelligence projects.

Depending on the project, Blackwork may also provide access to dedicated datasets, enhanced metadata, source information, archive materials, and additional resources that are not included in our standard Commercial or Extended licenses.

Can I redistribute or resell the original files?

No.

The original files included in Blackwork products may not be redistributed, resold, shared, sublicensed, uploaded, or made available to third parties under either the Commercial License or the Extended License.

This includes reselling the original files, redistributing them for free, uploading them to other marketplaces, including them in digital asset bundles or collections, sharing them through memberships or subscriptions, or making the original files available for download by third parties.

Both the Commercial and Extended License allow you to use the assets within your own projects, subject to the terms of the applicable license, but neither license grants redistribution or resale rights for the original files themselves.

If your project requires redistribution, sublicensing, white-label distribution, marketplace distribution, archive inclusion, or any other form of third-party file access, please contact us at [email protected] for a custom licensing agreement.

What is the difference between Commercial and Extended License?

The main difference between the Commercial and Extended License is the scope of use and distribution rights.

The Commercial License is designed for most professional projects, including client work, branding, websites, social media, editorial design, advertising, and other commercial applications where the assets are used as part of a final project.

The Extended License provides broader usage rights for projects involving large-scale distribution, resale-related products, print-on-demand, merchandise, commercial products for sale, or other uses that exceed the scope of a standard commercial license.

Are there limitations in what I can do with freebies?

All free products available on Blackwork are provided for Personal Use only.

Free resources may be used for personal learning, research, inspiration, private projects, and non-commercial creative work. They may not be used in commercial projects, client work, products for sale, print-on-demand products, merchandise, advertising, branding, marketing materials, or any project that generates direct or indirect revenue.

Free products are not covered by the Commercial or Extended License and cannot be used for commercial purposes unless a corresponding licensed version has been purchased.

I want to print a t-shirt with an artwork I created from one of your templates. Should I buy a license?

Whether you need a Commercial License or an Extended License depends on how the assets will be used.

The Commercial License covers most professional and business-related uses, including client work, branding, websites, social media content, editorial projects, advertising, and commercial creative work.

The Extended License is required for uses involving resale, print-on-demand products, merchandise, products for sale, large-scale distribution, or other applications that go beyond the scope of a standard Commercial License.
